Terms and Conditions
The acceptance of a membership application will constitute a legally binding agreement between the member and Gym Active Limited, by becoming a member you are agreeing to adhere to our Terms and Conditions at all times:
- Your membership will commence on the date you are issued a key fob or supplied with an access code, unless a later date is agreed in writing between us
- Membership fees are to be paid in full when due;
- All membership fees are non-refundable and non-transferable;
- Any late or unpaid membership fees may be subject to administration fees, payable on demand;
- You may cancel your membership at any time provided you give us a minimum of 1 months’ written notice, except for 1 month only memberships which will automatically expire at the end of their 1 month term. All requests for cancellation must be received in writing by email to info@gymactive.fitness and your membership will end on your usual payment date following the 1 month notice;
- We reserve the right to increase and/or vary our membership prices from time to time. We will provide you with a minimum of 1 months’ notice of any changes to our pricing. You have the option to end your membership during that period in the normal way. If you wish to continue as a member then the price of your membership will be varied on the date as communicated to you;
- You are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing your Membership Application Form.
- However, members accept that if they commence their membership immediately and then subsequently cancel their membership within the 14 day period, they will be refunded any monies paid, less a pro rata amount for the membership already used commencing from the first day after receiving their key fob (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013);
- In the event that a member does not comply with our Terms and Conditions or disregards our Code of Conduct their membership will be terminated without refund;
- All members acknowledge and accept that this is an unmanned gym and as such members are responsible for their own wellbeing at all times and are exercising at their own risk;
- By attending and using the gym, members are confirming that they are in good health and are not knowingly unable to engage in exercise or exercising against medical advice. Members are to update us as soon as possible if there are any changes to their health circumstances;
- At times there may be Gym Active Limited personnel or contractors in attendance at the gym, members agree that such persons have no responsibility and accept no liability for members using the gym at those times;
- Gym Active Limited reserves the right to make reasonable alterations to the types of equipment and facilities available without notice;
- It is inevitable that there may be occasions when we need to close part or all of the gym for essential works or maintenance. We will do our best to give members warning of such closures in advance whenever possible. Members will not be entitled to any refund of membership fees in such circumstances;
- Equipment and facilities are used entirely at members own risk;
- Members under the age of 16 are only permitted in the gym when accompanied and supervised at all times by a responsible adult member over the age of 18 years;
- A key fob will be provided to all members to gain access to the gym during unmanned hours. Members agree to their photograph being taken and stored by us when issuing key fobs. Replacement fobs will be charged at £10;
- Key fobs must only be used by the registered member. Any fraudulent use of key fobs will result in immediate cancellation of the membership without refund and the member will be barred for a minimum of 12 months;
- Gym Active Limited is not responsible for and accepts no liability for members personal items. Lockers are available for members use whilst at the gym;
- Members acknowledge and accept that CCTV is operational in the gym at all times. This will only be accessible to us and necessary third parties, including insurers and the police;
- Members must not access the gym when under the influence of alcohol or illegal drugs;
- We are committed to protecting your privacy, please see the Privacy Notice on our website;
- We may email members from time to time, Members are to ensure they keep us informed of any changes to their email address;
- All members are to comply with our Code of Conduct (see below).
Code of Conduct:
- Wear training shoes and suitable clothing
- Keep the gym tidy, including changing areas
- Wipe down equipment after use
- All weights and loose equipment to be put away after use
- Use all equipment and facilities properly – you will be responsible for any damage due to misuse
- Please be nice to other members!
- At busy times please be considerate in your use of equipment
- Do not allow access to the gym to non-members at any time – you are on CCTV
- Please do not leave items in the lockers – we will empty them
- Please do not touch the CCTV – this is for your safety and our security
- No unofficial personal trainers, only our approved personal trainers are to operate in the gym
- Remember this is an unmanned gym – do not exercise if you feel unwell and remember to bring your mobile phone. An emergency phone is located in Reception
- No eating in the gym
- Please report any issues, breakages etc as soon as possible via email to info@gymactive.fitness
